  • Notes from the District Court Hearing on the Motion to Intervene.

As of this moment, it seems to me the judge is NOT predisposed to allow the motion. The DOJ attorney has spoken, and the estate's attorney is speaking. At this point Mr. McCracken is better off not speaking.

Judge shut down McCraken's claim that the intervention is prejudicial to his claim.

Judge interprents McCracken's comments to support the government's argument. His mistake was to go on about how the searchers would damage the area.

The government's motion is for a "protective order." That's the intervention. Interestingly, the Government's attorney continues to refer to "park property."

She changed to "government property." She's making a good argument: What does where the treasure was found have to do with Mr. McCracken's claim?

Judge asks: Why is it that the govenment's claim isn't in a Federal Jurisdiction? She responds: there is no reason for this matter to be heard in this court. That is the motion to intervene. She is saying that the government wouldn't be here if McCracken hadn't moved to depose Stuef.
